Facing a PBM audit right now? Every stage of that process has a deadline, and every deadline works against you.
A PBM audit is rarely just a documentation request. Left unanswered or answered incompletely, it becomes a recoupment demand, a payment suspension, or a network termination, and the pharmacy is often the last to see it coming. Boesen & Snow’s audit team includes a former PBM auditor and pharmacist-attorneys who have defended hundreds of pharmacies through every stage of the PBM audit process, from the first notice to a final determination.
If you’ve received an audit notice, a discrepancy list, or a final finding, the fastest path to a better outcome is getting the right team involved now, not after the next letter arrives. And if you’re not there yet, we also help pharmacies get their documentation and processes in order before a notice ever comes.
A PBM audit runs on the provider manual, not just the letter you received, and manuals change constantly. Layer state-specific pharmacy audit laws on top, since they vary and often work in a pharmacy’s favor in ways a PBM has no reason to point out, and you’re facing a body of shifting requirements no pharmacy can track alone while also running a business.
It’s also not a fair fight by default. PBM audit teams do this full time, and once a dispute escalates, they’re backed by the PBM’s own legal department. Our team includes a former PBM lead auditor who built these audits from the inside, alongside pharmacist-attorneys who track these requirements, their changes, and the state laws behind them as a matter of routine.
PBM audits move through distinct stages, and the right move at each one is different. Our team handles pharmacies at any point in the process:
We represent independent retail pharmacies, specialty pharmacies, and multi-location and regional pharmacy groups facing PBM audits, disputes, and network actions across the country. Whether you’re a single-location pharmacy handling your first audit notice or a multi-site group managing several PBM relationships at once, our team has defended pharmacies at your scale.
Mark Ziegler Pharm.D a non attorney consultant spent years running audits inside one of the country’s largest PBMs, and now uses that insight for pharmacies instead of against them.
Our team stays current on every major PBM’s audit requirements, and how they change, so we know where the pitfalls are before a pharmacy has to go looking.
Hundreds of PBM audits handled, with a consistent record of substantially reducing claims pharmacies were never actually on the hook for.
Once a dispute reaches the PBM’s legal team, our litigation attorneys make sure a pharmacy has equal footing, not just at the start.
If you’re in the middle of a PBM audit, our priority is defending your pharmacy through this process, from the initial notice to a final determination and anything that follows it. Once you’re through it, ask us about PharmaFortify®, our proactive audit readiness program that helps make sure the next notice doesn’t catch your pharmacy off guard.
Look for a team with direct PBM audit experience, not just general healthcare litigation background. Our team includes pharmacist-attorneys who have defended pharmacies through hundreds of PBM audits across every major PBM.
Some PBMs label certain audits as investigations or special investigations rather than standard audits. These carry the same stakes and often stricter documentation demands, regardless of the label.
A PBM can begin withholding payment on new claims once a discrepancy amount is significant, even before a final determination is issued. The pharmacy remains contractually obligated to continue filling prescriptions during a suspension.
Many states legally require a PBM to allow an appeal of a final finding, often within about 30 days of it being issued, and most contracts require a good faith dispute process as well. Acting within that window significantly improves the odds a finding gets reopened.
Not automatically. Significant findings can lead to network termination, but terminations have been reversed or softened when a pharmacy moves quickly and addresses the PBM’s specific stated reasons.
